RIGHTS
ON THE WORKS IN COMPETITION AND NO WAIVER
1. The Romualdo Del Bianco Foundation, by simply receiving
the works of each participants, shall automatically
acquire the exclusive rights to use, publish, reproduce,
display and distribute the works delivered by any means
or support, both paper, television or Internet for as
long as possible as by law, not for profit and with
the only desire to disseminate the competing works and
their creators, who will always be mentioned along with
the work, although they will not be entitled to any
compensation. The transfer of the rights of use shall
be expressly accepted by the participants who agree
to renounce any related compensation, declaring to be
satisfied only with the possible dissemination of their
work delivered to the Romualdo Del Bianco Foundation.
2. The Romualdo Del Bianco Foundation shall not take
any responsibility about the reproduction or the dissemination
of the works, even in public by third parties.
3. The Romualdo Del Bianco Foundation shall consider
the opportunity to acquire exclusive rights to use and
disseminate one or more works in competition, by compensating
the author with a pre-determined amount of € 1.500,00
(one thousand five hundred) after signing a proper contract.
4. Each participant shall guarantee to realize and deliver
the Romualdo Del Bianco Foundation an original art work
whose rights of exploitation are fully owned by the
same participant. The Romualdo Del Bianco Foundation
shall not be deemed responsible for any claim for damage
or dispute from third parties concerning any violation
of the copyright or for any refutation and/or claim
of compensation. The Romualdo Del Bianco Foundation
shall reserve the right to proceed against any participant
in case his or her art work violates (partially or fully)
any previous right claimed by third parties on the presented
art work, including the copyright.
GENERAL CONDITIONS
1. According to legislative decree no. 196 art. 13,
of 30/06/2003, the data collected during the competition
shall be treated by the Romualdo Del Bianco Foundation
(Via del Giglio, 10 - 50123 Firenze - Italia) in order
to advertise the event and to inform the public, both
in Italy and abroad, about the activities linked to
the above-mentioned competition. The data treatment,
namely collection, organization, conservation, dissemination,
communication and also the combination of one or more
of the above-mentioned actions shall take place in compliance
with the above-mentioned regulations and shall be performed
correctly as by law. The above-mentioned data treatment
shall be performed by electronic means and/or on paper.
The party concerned shall be able to exert its rights
as by legislative decree 196/2003 art. 7 over the competent
offices. According to the same regulations, participants
shall express their consent to have their personal data
treated within the limits and the specific goals of
the competition.
2. All the moral rights on the delivered works shall
belong to the participants.
3. No compensation shall be due to the young participants
to the competition with the exception of the prize award.
4. The participation to the present competition and
the dispatch of the works realized by the participants
implies the automatic acceptation of all the clauses
regulating the competition, with no exclusion.
5. The Italian version of this call shall prevail for
any interpretation.
6. In case of any dispute, the court having jurisdiction
is the Court of Florence.
